SITE REMEDIATION PROFESSIONAL MGM'T

Brinkerhoff Environmental Services, Inc. handles LSRP projects as per NJDEP directives. Effective November 3, 2009, the Site Remediation and Reform Act (SRRA) required that an LSRP oversee certain environmental projects in New Jersey. Under this program, the NJDEP established mandatory timeframes for the completion of key phases of projects. The NJDEP maintains “direct oversight” in cases in which the remediating party is recalcitrant in conducting timely cleanups and for those sites that pose the greatest risk to human health and the environment. The NJDEP has also established presumptive remedies for residential development, schools, and childcare facilities. An assigned LSRP must notify the NJDEP in writing within 15 days of being assigned or dismissed from a LSRP-oversight project. The LSRP program is intended to expedite the remedial process. Brinkerhoff has the experience and carries the requisite insurance as required for LSRP services.

The SRRA, N.J.S.A. 58.10C-1 et seq., and Executive Order #140 implemented the law which changed the way in which sites are remediated in New Jersey and amended other statutes including the Brownfield and Contaminated Sites Act and the Spill Compensation and Control Act. The SRRA established a program for the licensing of LSRPs who now have responsibility for oversight of environmental investigation and cleanup. Brinkerhoff has approved LSRPs on staff who work to ensure sites are managed according to the SRRA. Under SRRA, NJDEP approval is no longer required prior to proceeding with remediation and sites can be cleaned up more quickly. LSRPs will issue a “Response Action Outcome” (RAO) which is the equivalent of the NJDEP’s prior “No Further Action” (NFA) letter.
